GENERAL CONDITIONS

(Pursuant to Chapter I, Title 3, Part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)

1. Preface and effectiveness of the General Conditions

These general sale conditions (hereinafter, "General Conditions") are valid for products and services purchases, carried out remotely and made available via Internet, from the website www.tastingmarche.com (hereinafter Site ) in compliance with Italian regulations of Legislative Decree 206/2005, as amended and supplemented (hereinafter, the "Consumer Code").

The seller of the goods and the owner of the site is: Tasting Marche Società Cooperativa with registered office at Frazione Gallignano 58/B, Ancona CF/PI No. 02629560422, REA: AN - 202 868 - Number of Albo Cooperative a Mutualità Prevalente: C100533. E-mail addresses: info@tastingmarche.com.it.

The consumer who wants to make purchases (hereinafter "Customer") is required to read these General Conditions before sending the order, which have been made available on the Site, and will be available at any time from customer through the link contained in the confirmation of each order.  

In the event that the person making purchases on the Site requiring the issuance of the invoice and /or otherwise is not a "private consumer" as defined in art. 3, paragraph 1, lett. a) of the Consumer Code, shall not apply the discipline of “return” pursuant to Art. 7 and 8 of the General Conditions or, more generally under the same Consumer Code shall apply only to " private consumers".

Contracts made by Tasting Marche through the Website are subjected to these General Conditions in accordance with Italian legislation. The language used to conclude the contract is Italian for sales whose shipments require as place of delivery Italy and English for all other places of delivery.

2. Choose and order products 

The features and price of various products on the website (hereinafter "Product" or "Products") are detailed for each product. For each product will be highlighted the net weight, the region and the country of origin, name of manufacturer and data-sheet with ingredients and nutritional values.

For the purchase of the Product, the Customer shall electronically complete and submit the order form, following the instructions contained in the Site. The Customer shall add the Product to the "shopping cart" and after having read the Terms and Conditions and the Policy Privacy has confirmed their acceptance, you must enter shipping information, select the desired payment method and confirm the order. The invoice will be sent only if requested by sending an e-mail to info@tastingmarche.com.

By placing an order on the Site, which has the value of the proposed contract, the Customer acknowledges and states that he has read all the instructions provided during the purchase process, to have read and understood the technical characteristics of the products and accept these terms and conditions and payment methods.

The contract between Tasting Marche and the Customer shall be concluded with the acceptance of the order by Tasting Marche. This acceptance is communicated to the customer through an email confirmation of the order with a reference to these general Conditions, the order number, shipping information, the list of products ordered and the total price, including VAT , where due, and delivery costs. The customer will check the confirmation email and whether he finds errors in the order will have 12 hours from the receipt of this email to contact Tasting Marche by sending an e-mail to info@tastingmarche.com after that time the order will be put into processing for shipment and changes will no longer be accepted, without prejudice the rights of the Customer referred to Article 7 below.

Once received the order, Tasting Marche will check the availability of the product to fulfil of the order. In the event that one or more products purchased will be not available Tasting Marche will indicate via email to the customer who, within the next 12 hours, will be entitled to respond to confirm the dispatch of additional basket or cancel it. In case of no response within that period, the order will be deemed to be confirmed and the products will be shipped. In this case, the full amount relating to the Products will be reversed, depending on the payment method and the amount will not be charged to the customer.

3. Products Information

Information and features related to products are available, with their product codes, on the Site. 

All information about the products can be found in Italian and in English. Tasting Marche guarantees that the delivered products will be equal to those described on the site and compliance with all rules regarding the storage of the goods until the time of delivery at the place specified in the order. For all products sold the manufacturer has the specific responsibility. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information given on the packaging. The photographs of product package may differ in shape, colors and materials with the actual ones.

The actual weight of the cold meats that will be shipped vacuum may differ by more than/less than 10% compared to what is stated in the product description.

 4. Prices and Shipments

Product prices are inclusive of all taxes and charges. All prices are expressed in Euro.

Tasting Marche want its product to be protected by shocks. For this reason the purchased products are properly packed.

To avoid product remain warm in couriers’ warehouses, shipments are made on Mondays, Tuesdays and Wednesdays for Italy; Mondays and Tuesdays for abroad.

  • Shipments to Italy:

    The site, based on the gross weight of the goods ordered, will calculate the shipping costs, which will be shown to the customer at the order check-out and before confirmation of the purchase. Shipments will be done with Express Courier "Standard shipping". For orders over 100 € the shipping is free in Italy and will be carried out according to the Standard mode. 

  • Shipment Abroad:

    The site, based on the gross weight of the goods ordered, will calculate the shipping costs, which will be shown to the customer at the order check-out and before confirmation of the purchase. Shipment will be done with Express Courier "Standard shipping". 

  • We don't sell and ship wine, beers and alcoholic drink  through e-commerce outside Italy.

    Orders can be submitted by sending an e-mail with the details to info@tastingmarche.com, Tasting Marche, once verified the validity of the Excise Code of the Customer, will send you a quotation.

5. Methods of payment and invoicing

5.1 Methods of payment

Customer may pay the total amount including products’prices and the shipping expenses, using credit card, PayPal and bank transfer “SEPA”.

  • Credit card

    The cards with which you can purchase on the Site are those identified as "commercial" by international VISA and MASTERCARD. To ensure maximum safety, the customer will make the payment transaction directly to the secure server of Banca Sella. Banca Sella uses SSL protocol to encrypt data transmitted between its server and the browser of the customer.

  • PayPal

    Once confirmed the order, the customer will be redirected to PayPal's site where he can make payment with its account or by using a card, whether prepaid or otherwise one method accepted by Paypal and in accordance with the general conditions.

  • Bank Transfer

    The Customer shall make the bank transfer within 3 days from the date of the order and send a receipt to info@tastingmarche.com. If this does not happen the order will be cancelled and the goods made available again to be purchased by other customers. The customer who has failed to make the transfer can be contacted by Customer Service in order to determine whether the cause of the payment failure depend on the will of the customer to not confirm the purchase, or other causes. In any case Tasting Marche reserves its right not to ship until it has received credit confirmation by its Bank.

    Reason for Payment: the Customer must indicate the payment date and order number, to be found in the confirmation email (eg "01/07/14 Order no. 10").

5.2 Orders Invoicing

If the purchase is made by a VAT holder it will be possible to request issuance of invoice by sending an e-mail where VAT number and the company’s data is to be indicated. In this case, the invoice will be emailed to the address indicated. Holders of VAT are responsible for the proper placement of billing information and are expressly informed that the bill may be requested within 7 days from the date of order.

6. Shipping and Delivery

The Products purchased on the Site will be delivered to the address specified by the customer during the purchase procedure in the field "Data Delivery". All purchases will be delivered by courier (hereinafter, "Courier") from Monday to Friday, except national holidays and festivities. Tasting Marche is not responsible for unpredictable delays, or not attributable to it.

Once shipped the products the customer will receive a confirmation email with details of the link for the shipment tracking.

In any case, except for reasons of force majeure or unforeseeable circumstances, the Products ordered will be shipped within a period of approximately 5-7 working days from the  day following that on which Tasting Marche has receipt the payment. .

Italy: delivery services UPS, DHL.

IThe service includes one delivery to the address indicated in the order. If the delivery failed due to costumer’s fault, the courier will leave a paper note inviting the customer to contact the nearest office within 24 hours to arrange for delivery or to change the address of that person. The Courier reserves the right to telephone the customer in case of failed delivery rather than leaving a written notice.

Abroad: delivery services UPS, DHL or other couriers.

Shipments abroad will be carried out with various couriers depending on the country of destination in order to ensure the client with the best available rate. Maximum weight of the shipment abroad:: 120 Kg 

7. Whitdrawal Procedures

As required by the Consumer Code LEGISLATIVE DECREE 206/05 (ex right of withdrawal) and Legislative Decree 21/2014, the Customer’s money will berefunded if not completely satisfied return the products within 14 working days of receipt, except for the case that they are products that by their nature are excluded pursuant to art. 59 of Legislative Decree 21/2014 (see next section IV). Such notice shall be sent by registered A/R, addressed to:

Once received the customer’s communication, Customer Service of Tasting Marche will open a practice for the management of withdrawal and to inform the customer instructions on how to return the products, which will be carried out by a courier signalled by Tasting Marche.

The right of withdrawal shall be governed by the following conditions:

  • The law applies to product purchased in its entirety; therefore, if the Product is made up of several components, the withdrawal cannot be exercised for a part or some parts of the product purchased.
  • In case of exercising the right of withdrawal Tasting Marche will refund the customer the full amount of the returned goods, including shipping charges if provided within 14 days from the date of receipt, subject to the right of Tasting Marche to suspend the payment of redemption proceeds until actual receipt of the goods. Refund will be made using the same method of payment used by the customer, unless he has expressly required a different mode. In case of bank transfer, the Buyer shall provide to the bank the count on which to obtain reimbursement (account, name and address of the Bank and IBAN).
  • Also in order to ensure the free return under article 8, the Products must be returned in the same box in which they were received.
  • The right of withdrawal is excluded in the following cases, pursuant to art. 59 of Legislative Decree 21/2014:
    • Customized Product;
    • Order products that are liable to rapidly deteriorate or expire;
    • Order of sealed products that have been unsealed after delivery, for reasons of hygiene and related to the protection of health.

With reference to the exclusion situations listed above, the withdrawal of the customer, in particular, is informed and agrees that among the definition “products that are liable to rapidly deteriorate or expire" Food & Beverage is included (wines, spirits and beverages), as the characteristics and qualities of these types of products are also subject to alteration as a result of improper storage. Therefore, for reasons of hygiene and customer protection, the right of withdrawal applies only to Products purchased on the Site that can be returned to Tasting Marche and put back on the market without risk to the health of consumers (such as books, gadgets, kitchen utensils, etc..)..

In cases of exclusion of the right of withdrawal, Tasting Marche will return to the Customer the Products purchased by charging the same shipping costs.

8. Free delivery in the event of exercise of the right of withdrawal

As a condition more favourable to the customer, Tasting Marche will pay the shipping costs for the return of the Products in the event of exercise of the right of withdrawal by the customer.

In order to qualify for this free shipping, the customer who wishes to exercise the right of withdrawal shall follow the procedure set out in Article 7 and wait to be contacted by Tasting Marche to arrange the return of the Products to the courier.

9. Warranty and defects of conformity for non-food products

In case of lack of conformity of products sold by Tasting Marche the Customer shall immediately contact Tasting Marche by phone (3470990929) or by sending an e-mail to info@tastingmarche.com. The sale of the Products is subject to the legal safeguards provided for in Articles 129, 130 and 132 of the Consumer Code. The customer has the right, at its option and subject to the nature of the product makes it possible, to restore, without charge, the conformity of the product by repair or replacement, or to an appropriate reduction of the price or the contract rescinded. The customer will lose these rights unless he makes a complaint to Tasting Marche about the lack of conformity within a period of two months from the date on which he discovered the defect, provided that it is not product that by its nature is perishable or subject to expiration in a shorter period, in which case the defect must be reported within that period reduced.

10. Mistakes and Limitations of Liability

Information regarding the products provided through the Website are constantly updated. However it is not possible to guarantee the complete absence of errors which Tasting Marche cannot be held responsible, except in cases of malice or gross negligence.

Tasting Marche reserves the right to correct any errors, inaccuracies or omissions, including after an order has been sent, or to change or update information at any time without prior notice, without prejudice to the rights of the Customer under these General Conditions and the Consumer Code.

Unless malice or gross negligence, the customer is not entitled to compensation for damages or company’s liability for direct or indirect damages to persons and/or property, caused by non-acceptance or fulfillment, also partial, of an order.

Tasting Marche promotes responsible consumption of alcohol and disclaims any responsibility, unless malice or gross negligence, in the case of a purchase of alcoholic beverages made by a child under 16 years old.

11. Complaints

Any complaint should be addressed to Tasting Marche by phone 3470990929 (Mon - Fri 9,00 – 17,00) o through mai a/r to the following adddress:

Tasting Marche shall respond to all requests received within a maximum of 7 working days.

12. applicable law and the competent courts.

The contract of sale between the customer and Tasting Marche is concluded in Italy and governed by Italian law. For the solution of disputes concerning the interpretation, performance or termination of these Genral Conditions or individual purchase orders if the customer is a consumer within the meaning of the Consumer Code, will be referred exclusively to the Court of his town of residence if located in Italian territory; in all other cases, the competence is exclusively of the Court of Ancona, any other jurisdiction is excluded.
